Computational systems are traditionally approached from control-oriented perspectives; however, as soon as we move from centralized to decentralized computational infrastructures, direct control needs to be replaced by distributed coordination mechanisms that are on par with institutional constructs observable in human societies (contracts, agreements, enforcement mechanisms, etc.). This paper presents a formalization of Hohfeld's framework building upon a logic whose language includes primitive operators of ability and parametric deontic operators. The proposal is meant to highlight the fundamental interaction between deontic and (...)

  27. The fair transaction model of informed consent: An alternative to autonomous authorization.Franklin G. Miller & Alan Wertheimer - 2011 - Kennedy Institute of Ethics Journal 21 (3):201-218.
Prevailing ethical thinking about informed consent to clinical research is characterized by theoretical confidence and practical disquiet. On the one hand, bioethicists are confident that informed consent is a fundamental norm. And, for the most part, they are confident that what makes consent to research valid is that it constitutes an autonomous authorization by the research participant. On the other hand, bioethicists are uneasy about the quality of consent in practice. One major source of this disquiet is substantial evidence of (...)

The transitions among classical mechanics, quantum mechanics, and stochastic quantum mechanics.Franklin E. Schroeck - 1982 - Foundations of Physics 12 (9):825-841.
Various formalisms for recasting quantum mechanics in the framework of classical mechanics on phase space are reviewed and compared. Recent results in stochastic quantum mechanics are shown to avoid the difficulties encountered by the earlier approach of Wigner, as well as to avoid the well-known incompatibilities of relativity and ordinary quantum theory. Specific mappings among the various formalisms are given.

This chapter proposes a dialectical approach to legal interpretation, consisting of three dimensions: a formalization of the canons of interpretation in terms of argumentation schemes; a dialectical classification of interpretive schemes; and a logical and computational model for comparing the arguments pro and contra an interpretation. The traditional interpretive maxims or canons used in both common and civil law are translated into defeasible patterns of arguments, which can be evaluated through sets of corresponding critical questions. These interpretive argumentation schemes are (...)

Eugenesia liberal y la crítica de Jürgen Habermas.Tomás Hernández Mora - forthcoming - Laguna.
This paper aims to analyze Jürgen Habermas’s critique of liberal eugenics and why it should be stopped. For this purpose, the concept of liberal eugenics, its features and goals, postmetaphysics in Habermas’s philosophy, will be exposed, as well as the notions of Körper and Leib, which are three key elements that the philosopher presents to articulate his critique. Next, the importance of the naturalness of birth and reciprocal relations between individuals, and how they can be affected by genetic modifications, will (...)

  39. Calibrating QALYs to Respect Equality of Persons.Donald Franklin - 2016 - Utilitas 29 (1):1-23.
Comparative valuation of different policy interventions often requires interpersonal comparability of benefit. In the field of health economics, the metric commonly used for such comparison, quality adjusted life years (QALYs) gained, has been criticized for failing to respect the equality of all persons’ intrinsic worth, including particularly those with disabilities. A methodology is proposed that interprets ‘full quality of life’ as the best health prospect that is achievable for the particular individual within the relevant budget constraint. This calibration is challenging (...)

Heaven and Earth Are Not Humane: The Problem of Evil in Classical Chinese Philosophy.Franklin Perkins - 2014 - Bloomington: Indiana University Press.
That bad things happen to good people was as true in early China as it is today. Franklin Perkins uses this observation as the thread by which to trace the effort by Chinese thinkers of the Warring States Period, a time of great conflict and division, to seek reconciliation between humankind and the world. Perkins provides rich new readings of classical Chinese texts and reflects on their significance for Western philosophical discourse.

On the stochastic measurement of incompatible spin components.Franklin E. Schroeck - 1982 - Foundations of Physics 12 (5):479-497.
Working in stochastic spin space and using POV measures as in the Davies and Lewis measurement scheme, we construct a formalism to describe the simultaneous measurement of incompatible spin components. The methods are illustrated with a new analysis of the Stern-Gerlach experiment, and with a discussion of spin dynamics in stochastic spin space. We also present a new short proof of a theorem on representations of spin-1/2 systems, find a joint spectral family for (noncommuting) spin components, and indicate the connection (...)

Corporate governance is often split between rule-based and principle-based approaches to regulation in different institutional contexts. This split is often informed by the types of institutional configurations, their strengths, and the complementarities within them. This approach to corporate governance regulation is mostly discussed in the context of developed economies and their regulatory demands. However, in developing and weak market economies, such as in Sub-Saharan Africa, there is no such explicit split and the debates on such contexts in the comparative corporate (...)

This book provides a framework for understanding the important and complex relationship between our emotional wellbeing and our sense of self, drawing on psychopathology, philosophy, and phenomenology.

A Critique of Clinical Equipoise: Therapeutic Misconception in the Ethics of Clinical Trials.Franklin G. Miller & Howard Brody - 2003 - Hastings Center Report 33 (3):19-28.
A predominant ethical view holds that physician‐investigators should conduct their research with therapeutic intent. And since a physician offering a therapy wouldn't prescribe second‐rate treatments, the experimental intervention and the best proven therapy should appear equally effective. "Clinical equipoise" is necessary. But this perspective is flawed. The ethics of research and of therapy are fundamentally different, and clinical equipoise should be abandoned.

English data is 77 minutes and 58 seconds long and comprises nine different panel interviews of political, socio-political and social issues and Spanish data is 78 minutes long and includes four political pre-electoral debates.
